Upon placing order, Specsview shall hand the Product to You and will be entitled to its payment for the Services. Specsview may accept or reject Your offer in its sole discretion which cannot be contested by You. However, the colours visible to You is solely dependent on Your monitor. Hence, no guarantee is provided by Specsview regarding Your visibility of the colours on the Website/s. Specsview does not provide any warranty or guarantee that the Product descriptions are accurate, complete, reliable, current, or error-free. If a Product offered by the Website/s is not as described, Your sole remedy is to return it in unused, unsoiled and resale condition. Specsview offers you the following services:

YOUR OBLIGATIONS TOWARDS THE PRODUCTS              

In surplus of Your other covenants in this Agreement, by ordering Product/s on the Website or Store You acknowledge and agree that:

  •  You have a written and valid prescription from a doctor for prescription glasses or lenses and the data provided to Specsview will be accurate
  • You consent to Specsview contacting your doctor to check the authenticity of the prescription if required
  • If the package cannot be delivered or if the product’s delivered at the wrong address, because of wrong information provided by You, then, any additional cost for delivery will be billed to you
  • All information provided by You including your contact details, name and address, bank or credit card details are Yours and authentic and there is no misrepresentation or fraudulent act from Your end
  • You will check the product description carefully before placing an order. By placing an order, You agree to be bound by the conditions of sale included in the product’s description.

INFORMATION REQUIRED FROM YOU                                    

After you have agreed to become a member and use the services from our Website, we will request from You specific data for registration. Once You have sent us that, we will ask for additional data to deliver our services. However, we will not ask You for any personal information or to disclose your identity. All data provided by You will be treated as personal and confidential. There is more information regarding this under the Privacy Policy clause.


ORDER AND DELIVERY OF PRODUCTS

  • Once you have ordered, an express request to purchase the Product is shown and it cannot be cancelled except in the conditions mentioned herein.
  • Based on the data provided by You and subject to verification of that, the Orders will be accepted by Specsview.
  • All orders will be processed once Specsview receives the payment for the Product.
  • You acknowledge that with respect to prescription glasses Specsview reserves the right to verify the same with Your prescribing doctor as well as independent qualified optician. And the acceptance of the order by Specsview is subject to the same.
  •  Specsview will use its maximum efforts to ensure that the order placed by You is successfully processed subject to its availability. In the event, the Product/s is sold out or out of stock, Specsview will inform you regarding the same and deliver an opportunity to buy a different product in the same price range.


PRICING AND PAYMENTS

  • The prices for Product/s are described on the Website/s and are incorporated into these terms by reference. All prices are in Indian rupees. The prices, products and services are subject to change at Specsview’s discretion. 
  • All prices are exclusive of any tax that may be required to be remitted to tax authorities.
  • Specsview will use its best efforts to ensure that the accuracy of the prices and price related information stated on the Website/s
  •  In the event of any inadvertent mistake by Specsview in quoting the price, Specsview will notify You of the error before Your payment is processed. You will then have the choice to either accept the correct price or to cancel Your Order.
  • Specsview accepts the following forms of payments: (1) Debit/Credit Card (2) Net Banking (3) Cash (4) UPI Payment
  • You agree, understand, confirm, and state that the card details provided by You to transact on the Website will be correct, accurate and is owned by You. In the event You use the card belonging to any third party, then, you confirm that you have been authorized to or expressly permitted by such third party to use the card for making payments.
  • Specsview will not be liable for any card related fraud. The liability for use of a card fraudulently will be on the User and the onus to 'prove otherwise' shall be exclusively on the User.
  • In addition to all other remedies available under law and equity and as detailed under this Agreement, Specsview reserves the right to recover the cost of Product/s, collection charges, attorney’s charges etc., from an User using the Website/s fraudulently. Further,Specsview reserves the right to initiate legal proceedings against such persons for fraudulent use of the Website/s and any other unlawful acts or acts or omissions in breach of these terms and conditions. (i) It is clarified that Specsview does not charge any fee or charges for the payments. If any specific charges or fee is charged by the payment gateways, the same will be specifically communicated to You in course of the transaction.

STORING, DELETING AND TRANSFERRING OF DATA

In case You require Specsview to remove all of your data or delete it partially, You need to send a written request to Specsview for it. Specsview states to you that it will not be able to retrieve the deleted data after that. Any management or control over the data will cease to exist after its deletion. However, only certain parts of data will be maintained on the backup logs only to support our System and servers in case a malfunction occurs. This is done to ensure continuity of service without any interruption.

TERMINATION OF TERMS AND CONDITIONS                        

This Agreement to be applicable and shall be binding on the parties, i.e., You and Specsview, unless terminated as specified below.

    • By You, by providing a written notice of at least 3 (three) business days.

    • closure of Your account by Specsview or You for any reason immediately.
